Abstract
South Carolina received a letter from the U.S. Department of Education on January 7, 1981, which cited the State as not being in compliance with Title VI of the Civil Rights Act and requested that the State submit a statewide desegregation plan within 60 days. In response to this request Governor Richard W. Riley submitted to the U.S. Department of Education on March 9, 1981, The South Carolina Plan for Equity and Equal Opportunity in the Public Colleges and Universities. The Department of Education's initial response (dated May 4, 1981) to the South Carolina Plan was received at the Commission on Higher Education on May 6, 1981. This response consisted of OCR's staff comments on the South Carolina Plan which were stated to be intended to highlight, in summary fashion, OCR's analysis of the Plan and to provide a basis for discussion about its modification. The South Carolina initial response to the OCR staff comments was mailed to the U.S. Department of Education on May 10, 1981. State officials engaged in negotiation sessions with officials from both the Washington and Atlanta offices of the U.S. Department of Education on May 14, 15, and 16, 1981. Certain modifications to the State's May 10, 1981, response to the U.S. Department of Education and South Carolina Plan were negotiated. These consisted of statements of explanation for clarification and additional information cited by the U.S. Department of Education officials as being necessary for an acceptable plan. The State's May 10, 1981, response was revised to incorporate the negotiated modifications in the South Carolina Plan. Consequently, South Carolina's revised response becomes an attachment to the Plan.
