The South Carolina Department of Agriculture (“SCDA”) provides these copies of the regulations for the convenience of the public and makes every effort to ensure their accuracy. However, these are unofficial versions of the regulations. The regulation's most recent final publication in the South Carolina State Register presents the official, legal version of the regulation. The official version refers to the South Carolina Department of Health and Environmental Control (DHEC). However, after July 1, 2024, all references to DHEC must be construed as references to SCDA.

    Regulation 61-36 : Manufactured Grade Dairy Products

    No person within South Carolina, or its jurisdiction, shall produce, provide, sell, offer, or expose for sale, or have in possession with intent to sell, any Manufactured Grade Dairy Product that is adulterated or misbranded. This includes but is not limited to types of milk, butter, or alcohol-infused dairy products.

    Regulation 61-34 : Raw Milk for Human Consumption

    This regulation contains information for those who wish to sell raw milk for human consumption. All raw milk and raw milk products for human consumption shall be bottled, packaged, and sealed at the same location where they were produced, or, in the case of raw milk products, at a location under the direct control of the raw milk producer that has been approved by the Department, and all raw milk and raw milk products shall conform to the chemical, physical, bacteriological, and temperature standards as well as the sanitation requirements of this Regulation.

    Regulation 61-34.1 : Pasteurized Milk and Milk Products

    This regulation prohibits the production, sale, or possession with intent to sell adulterated or misbranded milk and milk products within the state, except during emergencies when ungraded milk can be authorized and labeled as such by the Department of Agriculture. Adulterated or misbranded products can be impounded and disposed of, and these products are subject to examination by Department of Agriculture to ensure compliance.

    This regulation covers food supplies in retail food establishments. It requires that all food must come from approved sources and be properly labeled, free from spoilage and contamination, and safe for consumption.
